Saiful's father wants petition of appeal filed


Azlan Mohd Lazim, the father of complainant Mohd Saiful Bukhari Azlan, has made an impassioned plea to the Attorney-General’s Chambers (AGC) to file the petition of appeal and not be influenced by certain quarters into not filing it.

Meanwhile, Saiful said last week was exactly four years ago since he lodged the police report.

“I do not regret it, despite being humiliated by people, but not in the eyes of Allah. I will continue to be patient and pray,” said Saiful in a tweet today. 

Azlan, in a statement on his son’s blog, said he had received news that the written judgment by High Court judge Justice Mohamad Zabidin Mohd Diah is out and till now he and his family has not read its contents and could not comment on it.l

“Although it has been six months waiting, we welcome this recent development,” he said.

“However, what is important now is that the AG consider filing the petition of appeal within the 10-day period. Now a couple more days are left.” 

NONEAzlan (right) believes his son as a citizen who respects the federal constitution, wants to see the appeal take place.

“This is to ensure that my son is not denied of his rights should the AG decide not to file it. Whatever it is, I urge the AG not to be influenced by demands by certain quarters not to file the petition,” he said.

Azlan however, did not name the quarter whom he claimed may influence the AG not to file it.

Yesterday it was reported that the full written judgment by Justice Zabidin is out and AGC trial and appeal division head Kamaluddin Md Said had said they are working hard to file the petition within the period.

The petition will contain the written judgment which is part of the records of appeal, and also the grounds of the prosecution’s appeal.

PKR: probe allegations of fabrication

Meanwhile, in an unrelated development, PKR vice-president N Surendran said the written judgment clearly indicates that evidence may have been fabricated against Anwar. Calling for a thorough probe on the alleged incidents of fabrication in Sodomy I and II, Surendran said an impartial investigation must be launched into both trials. 

“Judge Zabidin states that the crucial samples bag was cut open by the police investigating officer, even though there was no necessity to do so. This is nothing less than police tampering with evidence. Who gave instructions to the investigating officer to meddle with the samples? How could this have happened in an important police investigation involving a high-profile defendant? 

“The judge further said that the sample bags were not tamper-proof and that the seal could be removed and resealed. This indicates both intent and opportunity on the part of the authorities to tamper with and fabricate evidence against the nation’s parliamentary opposition leader,” he said.

NONEDescribing the judge’s findings as revealing and shocking, Surendran (left) said it also indicates the extent to which the criminal justice system has been undermined by the BN government.

He further pointed out the pattern of fabricating scientific evidence is consistent with allegations of such episodes being done in Sodomy I in 1998.
 
Surendran said former Kuala Lumpur CID chief Mat Zain Ibrahim has confirmed that Anwar’s blood sample was taken from the Hospital Kuala Lumpur on Oct 15, 1998 to fabricate DNA evidence against Anwar. 

“Mat Zain Ibrahim had implicated former inspector-general of police Musa Hassan and present attorney-general Abdul Gani Patail in the incident. The government has yet to satisfactorily respond to Mat Zain’s serious allegations. This trail of deceit, fabrication and criminality leads back to Umno and the BN leaders. 

“The long persecution of Anwar could not have been carried out without the approval and connivance of Prime Minister Najib Abdul Razak and Umno leaders, including former premier Dr Mahathir Mohamad,” he said.

Najib, he said, must stop pretending he has no control or influence on the sodomy appeal against Anwar. 

In light of Justice Zabidin’s findings, Surendran also urged Najib and Gani to drop the pending prosecution appeal against Anwar’s acquittal.
