590 HECTARES EXCISED FROM FOREST RESERVE



OVER 3,000 people residing in 13 villages within the Gumantong-Guluang-Gesusu Forest Reserve Class 1 have reason to smile now that the State Legislative Assembly has approved an amendment to de-gazette the status of the forest.

Matunggong Assemblyman Sarapin Magana, who welcomed the decision, said it would enable long-standing land applications by the villagers to be processed by the Land and Survey Department and local authorities.
"I am very grateful to Chief Minister Datuk Seri Musa Aman for being concerned for the need of the villagers to occupy 590 hectares in the three areas.

"De-gazetting the three areas in the forest reserve is really good news and timely to the 3,500 villagers because they strongly believe they have native customary rights on the land as they have been living there for many generations.

"Also, they have been toiling the land for so long by planting rubber, coconut trees and oil palm and have been enjoying the harvests.

In addition, they have built their family homes and ancestral burial grounds in the three areas," he said.

Sarapin said this after the approval of the amendment to de-gazette the Gumantong-Guluang-Gesusu Forest Reserve Class 1, Wednesday.

The 590 hectares have been de-gazetted for the purpose of agriculture and settlements. These areas are found not suitable to be retained as Forest Reserves as the areas are titled land, occupied by settlers and have been degraded.

"Actually the area was gazetted as Forest Reserve Class 1 in 2007. However, the villagers only realised that they are living inside the forest reserve belonging to the State Government, last year," said Sarapin.

"Therefore, they submitted their objection to me as the elected people representative and sought help to bring out the 13 villages from the forest reserve on the grounds that they have been living there for so many years.

"Together with Kota Marudu MP Datuk Dr Maximus Ongkili, I highlighted the issue to the Assembly last year to de-gazette and the Government agreed to do so in the same year," he said.

However, Sarapin said the matter was not yet discussed as a Bill at the sitting last year and he explained to the villagers that the process would take some time.

Unfortunately, the opposition played the issue up to fish for votes by claiming that the Government wanted to grab the land from the villagers.

"On behalf of the villagers, thank the government for its concern for the needs of the locals in line with the 1Malaysia concept: People's First, Performance Now," Sarapin said. (DE)

  5. Native wishing to make any NCR claim under Section 14 of the Sabah Land Ordinance can still submit their claim to the Assistant Collector of Land Revenue (ACLR) notwithstanding the provisions under the 1930 amendment to the Land Ordinance.

As a result of the1930 amendment all land in then North Borneo became government land (now known as state land).  Following the amendment, the occupation of state land by any native is subject to sections 5, 6(1), 65 and 88 of the Land Ordinance, whereby the occupation must comply with certain criteria under the land law. If the occupation is found to be legitimate and fulfill the criteria set out under section 15 of the Land Ordinance, the occupation will be considered and recognized under NCR occupation and land ownership may be granted.

  8. The Chief Minister gave statistics over a 15-years period between 1997 until September 2012 to show that NCR has been alive and well. He disclosed that the Lands and Survey Department received and registered 615 NCR land claims cases, involving 1,164 claimants. Of these, 207 cases were given NCR recognition, 70 cases were found to be groundless and were thus rejected while 338 cases are still under process.

Recently, The Sabah Forestry Department had decided to re-gazette 183,000 hectares of Class 2 Commercial Forests into Class 1 Protection Forests to expand the expanse of totally protected forests in the state. This “bold” upward reclassification exercise involves principally lowland forest ecosystem in Ulu Segama and Gunung Rara Forest Reserves, in pursuance of Musa’s decision.

Both areas, although logged over, are important wildlife habitats and are homes to iconic species such as orang-utan, pygmy elephants and the Bornean clouded leopard.

Class 1 Protection Forests are given strict protection primarily for safeguarding water sheds, maintenance of stability of essential climatic and environmental factors, in addition to biodiversity conservation. Under the Forest Enactment 1968 (Sabah), the law forbids any form of conversion such as conversion into oil palm plantations or timber exploitation in a Class 1 Forest.

  15. After the gazettement of the Protection Forest Reserves in 1984, a total of 44 were gazetted as class 1 Forests, including the controversial Kukusan Hill Forest Reserve, Tawau, which was declassified to Class 2 in 2003. The last Class 1 gazettement was Maliau Basin Forest Reserve in 1997.

The latest decision by Musa will increase the area under total protection to about 1,300,000 hectares or some 17.5 per cent of Sabah’s total land area, exceeding the IUCN standard of 10 percent. Musa’s model of good governance is being applauded within the country and beyond. The way he has won the hearts of people of Sabah and his popularity at the national level shows that ‘Good governance is also good politics’.

Kerajaan Sabah beralih kepada kelapa sawit untuk mendapatkan hasil yang lebih banyak berikutan royalti kayu balak yang menurun dengan banyaknya sejak 20 tahun yang lalu dan kemungkinan besar, kekal rendah untuk 20 tahun lagi. Ini berikutan larangan membalak dan mengeksport papan untuk mengeluarkan kayu mampan serta memulihara hutan.

Up to Dec 2011, seven Communal Land Titles had been issued totalling 12,777.14ha for 2,661 beneficiaries in three districts, another 52 Communal Title for 23,046.07ha of land would be issued to 5,373 beneficiaries in 7 districts.

    Meanwhile, the Chief Minister pointed out that the state govenrment had carried out its fudiciary responsibility to its level best in preserving and protecting the natives’ customary land rights and land ownership.

    “The accusations that the government ignored NCR land claims and discriminated in giving land to natives are unfounded and not true,”he stressed.

    Yesterday, Musa also informed the House that the then Birtish North Borneo Chartered Company took 41 years to formulate a land legislation on NCR – the Land Ordinance – to protect native land rights and land ownership in accordance with Article No. 9 of the English Royal Charter.

    The objective of the Ordinance was to manage the allocation and ownership of land in an efficient manner.

    “And to realise this objective, the Beitish administation incorporated new provisions in Sections 5, 6, 65 and 88.


    “For the information of the Assembly members, Section 6 concerns ‘government property land’, Section 6 is related to ‘unlawful occupation not to establish any right’ while Sections 65 and 88 are about ‘customary tenure and ‘no title or claim to land valud unless registered.”

    Musa Aman has the distinction of being the longest serving Chief Minister of the state of Sabah. He firstly assumed this responsibility in March 27th 2003. Thereafter, he has had sweeping victories in two successive Assembly Elections held in 2004 and March 2008.     Musa Aman mooted a model of development through people’s participation. USP of his development model has been a quantum leap (think big) and change right from the roots (no cosmetic changes). Sabah recorded the biggest gross output in agriculture compared to other states in the country. Agriculture production including short term and long term crops have quadrupled. Sabah produced RM13.21 billion or 24.7 per cent of the total of RM53.45 billion agricultural output in Malaysia last year.

    Working in harmony with the Federal Ministries, Musa’s Government has brought qualitative change in health services and health infrastructure to ensure a healthy mother and child in the very remote areas of Sabah. Focus on cent per cent enrollment of children through campaigns and resultant drooping drop out rates have been able to reverse the trend of high illiteracy rate from Sabah.

    Even in the forest sector Musa has done a wonderful job as he has been pursuing for good forest and environmental governance in the interest of future generations to come. Recently, The Sabah Forestry Department had decided to re-gazette 183,000 hectares of Class 2 Commercial Forests into Class 1 Protection Forests to expand the expanse of totally protected forests in the state. This “bold” upward reclassification exercise involves principally lowland forest ecosystem in Ulu Segama and Gunung Rara Forest Reserves, in pursuance of Musa’s decision. This exercise shall mean that Danum Valley on its eastern fringes will be buffered by totally protected forests and in particular, the biologically rich Ulu Segama Forest Reserve (127,890 hectares) can no longer be logged now or in the future because of legislative protection.

    At the same time, Northern Gunung Rara (55,000 hectares), which forms a vital wildlife buffer from Maliau Basin and Imbak Canyon to Danum Valley, will also be accorded full protection. Both areas, although logged over, are important wildlife habitats and are homes to iconic species such as orang-utan, pygmy elephants and the Bornean clouded leopard.

    Class 1 Protection Forests are given strict protection primarily for safeguarding water sheds, maintenance of stability of essential climatic and environmental factors, in addition to biodiversity conservation. Under the Forest Enactment 1968 (Sabah), the law forbids any form of conversion such as conversion into oil palm plantations or timber exploitation in a Class 1 Forest. After the gazettement of the Protection Forest Reserves in 1984, a total of 44 were gazetted as class 1 Forests, including the controversial Kukusan Hill Forest Reserve, Tawau, which was declassified to Class 2 in 2003. The last Class 1 gazettement was Maliau Basin Forest Reserve in 1997.

    The latest decision by Musa will increase the area under total protection to about 1,300,000 hectares or some 17.5 per cent of Sabah’s total land area, exceeding the IUCN standard of 10 percent. Musa’s model of good governance is being applauded within the country and beyond. The way he has won the hearts of people of Sabah and his popularity at the national level shows that ‘Good governance is also good politics’.
