High Court says Bersih 2.0 arrest of PAS veeps wrongful



The Kuala Lumpur High Court today declared that the arrests of PAS vice-presidents Mahfuz Omar and Salahuddin Ayub during the Bersih 2.0 rally were wrongful.

NONEIn delivering the decision, judge Prasad Sandosham Abraham ordered the government and the Royal Malaysian Police (PDRM) to pay damages amounting to RM70,000 to each of them.

The decision was read in the Shah Alam High Court as Justice Prasad has been transferred there.

Contacted by Malaysiakini today, their lawyer Zulhazmi Shariff said the two PAS leaders had filed their claims in the Kuala Lumpur High Court on Aug 8 last year, seeking damages over their wrongful arrests during the Bersih rally last year.

Mahfuz and Salahuddin (below, second and third from left in photo), the MPs for Pokok Sena and Kubang Kerian respectively, were arrested at the entrance to the KL Sentral during the July 9 rally calling for electoral reform, for violating the restriction order issued on July 7 against 91 individuals, including themselves.

NONEHowever, theypointed out that the 91 were barred from being at Jalan Syed Putra, Jalan Istana, Jalan Bukit Petaling, Jalan Bellamy and the area surrounding Istana Negara, but not the KL Sentral area.
According toPAS-owned news portalHarakah Daily, both of them were detained at the Jinjang police station for some 10 hours before being released later that night.

It was reported they had filed defamation suits against the government, inspector- general of police, Brickfields district police chief and an Inspector Mohd Zaid, over their arrests.
