Mystery lawyer in Bala's SD2 urged to reveal self to Bar



The lawyer who drafted the second statutory declaration that private investigator P Balasubramaniam was allegedly compelled to sign should make himself known to the Bar Council, says Bala's lawyer Americk Sidhu.

Americk said that this is so that innocent individuals were not wrongly accused by the public, including veteran lawyer Cecil Abraham and his son Sunil, whom Americk does not believe were involved.

americk siva pc 040708 02Americk (left) said in an email toMalaysiakini that his client could not lodge a complaint to the Bar Council as Balasubramaniam never met the mysterious lawyer, nor had he instructed the lawyer to draft the second statutory declaration (SD).

“As this is a rather serious matter, may I suggest that the president of the Bar Council organises a simple email to be sent to all members of the Malaysian Bar requesting that the member(s) responsible for drafting that second SD do the right thing and make themselves known.

“(This is because) it appears innocent parties may be publicly falling victim to the blame game and finger-pointing which has emerged since Deepak’s revelations, to which I certainly do not subscribe,” he said, referring to the allegations made by carpet trader Deepak Jaikishen.

Relating the events surrounding the signing of the second SD, Americk claimed Balasubramaniam had signed it after his family's safety was threatened, with a commissioner of oaths bearing witness.

He said that unlike the first SD, which was two months in the making, the second SD took less than a day.

Americk said the address on the commissioner of oaths' stamp, as noted on the second SD, was the same as law firm Zul Rafique & Partners in 2008. Cecil is a senior partner at the same law firm.

Centre of speculation


NONEHe added that Cecil and his son have been at the centre of speculation after Deepak's (right) interview withHarakahDaily.

However, the lawyer's name was bleeped out of the video of the interview, which was posted on YouTube.

Lawyer and activist Haris Ibrahim, who has sent a complaint against the mystery lawyer to the Bar Council, claims that the lawyer is a 'Tan Sri', fuelling speculation that the person is Cecil.
Americk, in the statement, further stressed that he knew Cecil personally and did not believe that someone with his “dignity, integrity and professionalism” would be involved in such a thing.

He added that Cecil had dedicated “40 years of his life in upholding all that is sacrosanct”.

Malaysiakini has contacted both Cecil and his son and is awaiting their replies.
