MCMC: ISPs found restricting access can be punished



The Malaysian Communications and Multimedia Commission (MCMC) has not probed Malaysiakini's claim that that internet service providers (ISP) were throttling trafic to its website because no official complaint was lodged.

“So far we have only received one official complaint on Monday, 29 April 2013, from UMNO Online claiming that its readers faced difficulty in accessing the portal. 

"However, we are still waiting for an official complaint fromMalaysiakini on the same matter,” according to MCMC strategic communications head Sheikh Raffie Abd Rahman.

Sheikh Raffir added that preliminary investigations indicate that there were no such restrictions by ISPs and MCMC viewed the allegations with "great concern".

"If the ISPs were found to have restricted access not in accordance with the law, action can be taken under the Communications and Multimedia Act 1998 for breaching their licence conditions," he said.
Many reasons
He added that the public should not speculate on the allegations until proper investigations are conducted, as there could be many reasons - such as being unable to cope with an increase in traffic - for the problems faced by the affected websites.
In an immediate response, Malaysiakini chief executive officer Premesh Chandran said he had provided evidence of Malaysiakini'stroubles with several ISPs over the past week, but did not make an official complaint.

"We've shared our test scripts with MCMC last Friday and have been in touch with engineers from TM since Monday to resolve the restriction issues. 

"We have also sent them the posts done by independent parties with regards to the disruption of our Youtube video. We will make our complain 'official' today," he said.

Investigations by Malaysiakini showed that some ISPs were throttling traffic to the website and some of its videos on Youtube, frustrating user access.

However, users of some ISPs such as YES YTL and Time Internet did not face such problems.
