Seri Kembangan sisters who SEXUALLY assaulted maid to stay in jail
Two sisters who caused hurt and sexually abused their Indonesian maid will remain in prison to serve a five-year and eight-month jail sentence.
Wong Choy Lin, 41, and Choy Kin, 39, failed in their bid today to have the Court of Appeal's earlier decision reviewed.
The women applied to review the earlier decision of the Court of Appeal which did not grant them leave to appeal against their conviction and jail sentences.
An accused person has to obtain leave before the Court of Appeal, if a case originates from the magistrate's court.
The Court of Appeal's three-member panel chaired by Datuk Ramly Ali unanimously dismissed their review application. "We find no special circumstances to justify our exercise of discretion to allow the review," he said.
Presiding on the panel with Ramly were justices Datuk David Wong Dak Wah and Datuk Mohd Zawawi Salleh.
The sisters were convicted and sentenced to jail by the magistrate's court in Petaling Jaya on Oct 2011, on charges of voluntarily causing hurt and assaulting Hanif Muawanah Muhyion, 25, from Surabaya, with intention to outrage her modesty between November 2003 and September 2004 at a house in Taman Bukit Serdang, Seri Kembangan.
They were sentenced to two years' jail for assaulting her by inserting objects, like biscuits, banana and a bottle, into her private part and eight months' jail for voluntarily causing hurt.
The magistrate's court ordered them to serve the sentences concurrently. Both sisters appealed to the High Court against their conviction and jail sentences while the prosecution cross-appealed against the inadequacy of punishment.
On Sept 11, last year, the Shah Alam High Court dismissed the sisters' appeal against their conviction and jail sentence.
The High Court allowed the prosecution's cross-appeal and enhanced to five years for sexual assault and maintained the eight months' jail term for causing hurt, to be served consecutively.
Both sisters appealed to the High Court against their conviction and jail sentences while the prosecution cross-appealed against the inadequacy of punishment.
Earlier, counsel Hisyam Teh Poh Teik told the court that his clients wanted a chance to appeal against the High Court's decision which enhanced their jail term.
Deputy Public Prosecutor Tengku Intan Suraya Tengku Ismail argued that there was no special circumstances in the case to allow the review.
