Uthaya files legal action against prison authorites


Human Rights Party and Hindu Rights Action Force leader P Uthayakumar is seeking to initiate committal proceedings against the Kajang prison director and two other officers.

Uthayakumar had filed an application with the Kuala Lumpur High Court yesterday, alleging that the prison authorities did not comply with KL High Court judge Azman Husin's order to allow the detainee's lawyers to meet him.

He named Kajang prison director Abdul Wahab Abdul Kassim, its inspector Sajideh Samin and another inspector, known only as Mackenzie as respondents.

In the notice of motion filed through the firm M Manogar and Co, Uthayakumar, who is serving two years and six months jail for sedition, said Azman had also ordered that he be placed in a separate cell for political prisoners.

In Uthayakumar's affidavit in support of the application, he said that during the hearing before Azman, he (Uthayakumar) had submitted that political leaders like Lim Guan Eng, Mohamad Sabu, and Anwar Ibrahim  were held at the hospital prison block for security and safety reasons.

He said following an application from his lawyer M Manoharan, the court in a letter dated Dec 12 last year allowed that he be separated from other prisoners, and placed in a special place for political prisoners, and that he be allowed to meet Prof Dr Shanmugarajah from UKM hospital to seek treatment.

"However, the court order was not followed. Sometime in February this year, Uthayakumar brought this matter to the attention of the chief inspector to inform the prison director over this.

"However, the prison director did not abide by this directive. As a result, Manoharan's law firm had issued a letter dated March 4 this year informing the judge that the conditions were not followed," the application read.

Till today, Uthayakumar said the conditions have not improved, adding that to make matters worse, the prison director, “aggravated the contempt” by placing “five dangerous hardcore criminals” involved in murder and armed robbery in his lock-up.

Uthayakumar claimed that unhygienic conditions resulted in his suffering from scabies, forcing him to seek treatment.

He further claimed that the prison director acted mala fide (bad intention) by putting five prisoners in his cell in contrast t other cells that held three.

The Hindraf leader also urged that all his public interest complaints where prisoners are stripped naked in public and required to spread their behinds to make sure there are no tobacco or drugs smuggled and other forms of abuse of  prisoners be answered.
