Putrajaya will have to bear all expenses related to sending Muhammad Rizalman Ismail, 38, back to Wellington to face charges of sexually assaulting a woman, reports New Zealand media today.
Rizalman, a Second Warrant officer attached to the Malaysian High Commission in Wellington, is accused of following Tania Billingsley, 22, home and assaulting her with intent to rape on May 9.
On May 22, Rizalman flew back to Malaysia after Wisma Putra invoked diplomatic immunity for him and on May 29, an email from police to court officials noted that Rizalman had left New Zealand.
According to the New Zealand Herald, it was unclear when Rizalman would return to Wellington but it said, he would be arrested and taken into custody as soon as he arrived.
Stephen Hoadley, associate professor of political studies at Auckland University, told the paper that Rizalman would appear in court where his defence counsel could lodge a bail application.
It was likely the New Zealand authorities would order a fresh evaluation on his mental state to see if he was fit to stand trial.
If Rizalman was granted bail, he would be housed at the Malaysian High Commission, Hoadley said, and would face restrictions to his movements.
Rizalman would most likely have to surrender his passport, said the NZ Herald.
"The Malaysian government stands behind him and has agreed with the New Zealand government that he will go to trial... The danger of him absconding is low because his own government will guide him and make sure that he appears in the right place at the right time," Hoadley was quoted as saying.
