In his verdict, Judge Ahmad Bache said that police officers from Cheras and Dang Wangi district police headquarters had committed unlawful omission resulting in the death of Chandran, 47, by not giving him medication for his illness and not taking responsible action.
“The death of the deceased is due to a hypertensive heart disease and this is due to police not giving or allowing medicine related to his problem,” Amad was quoted by news portal Malaysiakini as saying.
Chandran, a 47-year-old man from Simpang Renggam, was remanded at the Dang Wangi lock-up on suspicion of abducting the baby of an Indonesian woman.
He was not allowed medicine or medical treatment in lock-up, and died on September 10, 2012, after four days there.
Chandran’s case is the first time a sessions court judge in Kuala Lumpur has acted as a coroner, a role previously limited to a magistrate— following a directive by Chief Justice Arifin Zakaria that inquests by a coroner should handled by sessions court judges.
