Water restructuring direction up to Selangor govt

The ball is in the Selangor State Government's court as Minister says that he has exhausted all avenues on his side.

PUTRAJAYA: The Federal Government has decided to leave it to the state government on the direction of Selangor water supply restructuring after a Master Agreement failed to be concluded on April 30, said Minister of Energy, Green Technology and Water (KeTTHA) Maximus Ongkili.
He said he had written a letter to the Menteri Besar of Selangor Mohamed Azmin Ali on April 30 on the matter.
“It is up to him to settle the issue of transferring water assets and taking over completely the concessionaires of Selangor water as contained in the agreement,” the minister said.
Nevertheless, he said the Federal Government would continue to be committed to finalise the restructuring to ensure security of water supply in Selangor, Kuala Lumpur and Putrajaya.
“Apparently, there are still obstacles at the Selangor State Government level so in the letter I said ‘the ball is in your court’ and it is up to him to settle because on my side I have exhausted (all avenues).
“We have fulfilled our part and it is now time for Selangor to fulfill theirs but the Federal Government has not shut its doors,” Ongkili told reporters after handing over excellence awards to 63 staff of KeTTHA, in Putrajaya, Friday.
Ongkili, prior to this, said the Selangor State Government was given until April 30 to respond on the Master Agreement, after being postponed several times from the last deadline on January 12, following the issue of transferring two water assets in Bukit Nenas and Semenyih to Pengurusan Aset Air Berhad (PAAB).
He said the Federal Government was prepared to hand over the RM2 billion allocation to help the State Government take over the equity of the water concession companies if the State Government could provide other assets which had adequate value to replace the two assets in question.
According to Ongkili, at the meeting between officers of both sides, the Selangor State Government had identified four other water assets whose ownerships could be transferred but it could still not be finalised.
“I cannot name the four assets yet because it is still at the discussion stage, but apparently they are not yet ready to release the four assets,” he said.
He said the Selangor State Government continued to claim that the land on which the Bukit Nenas and the Semenyih plants were located belongs to Selangor, but legally the claim is without basis.
Meanwhile, Ongkili said the Langat 2 Water Treatment Project and the distribution system would be continued, and the Federal Government would consider legal action if the Selangor State Government continued to postpone the issuance of permits for the project.
He said the Federal Government would defend the heads of agreement (HoA) which was signed by both parties on the project because it is not subject to the Master Agreement.
“We will take action, maybe under Article 114 of the Federal Constitution if there are certain obstacles, to ensure the interest and welfare of the people are protected, but we have not reached that level to date.
“We have yet to receive several permits, and land, which are still needed, and we hope they respect the HoA,” he added.
