RoS acknowledges Subramaniam’s suspension, says MIC sec-gen

The tables seemed to have turned against Datuk Seri Dr S. Subramaniam in the MIC leadership spat after it was revealed today that the Registrar of Societies (RoS ) will officially note his suspension from the party, which was decided some 10 days ago, a leader of the faction aligned to Datuk Seri G. Palanivel said today.

MIC secretary-general Datuk S. Sothinathan said RoS told him that it would put on record the contents of two letters sent by Palanivel's faction about the friction between the two sides and notify Dr Subramaniam.‎
"We sent a letter dated Jun‎e 17 announcing the suspension of Dr Subramaniam and 14 others from MIC.
"Today, we sent another letter explaining the resolutions passed in our meeting yesterday and that Dr Subramaniam had twisted the letter RoS had sent to him yesterday to remove Palanivel as a MIC member," Sothinathan told reporters after meeting with RoS officials in Putrajaya today.

‎Yesterday, Dr Subramaniam said the RoS had confirmed that Palanivel was no longer a member of the Barisan Nasional's largest ethic Indian-based party and that he had been appointed the acting president to replace the Palanivel.
"RoS in a letter addressed to the central working committee (CWC) 2009 today has recognised that Datuk Seri G. Palanivel is no more a member of the MIC as per Article 91 of the MIC constitution," Dr Subramaniam said in a statement yesterday.
"RoS has also recognised that consequent to this that Dr Subramaniam will function in the capacity of acting president to lead the CWC 2009 to conduct the re-elections of the MIC as per the RoS decision."
But Palanivel refuted this earlier today, saying Dr Subramaniam was wrong to have misled people in saying the RoS had confirmed his removal based on Article 91 of the MIC constitution, as the government agency was not the correct party to interpret the constitution.

"RoS had not made any determination on the application of Article 91 of the MIC constitution.
"RoS knows that they have no such jurisdiction to interpret the MIC constitution," Palanivel said in a statement today.
Sothinathan said only the MIC president and CWC members had powers to interpret the party constitution and not the RoS.
"They (RoS) have agreed to give us the notification on Monday. We stated in our letter that the interpretation of the constitution is the prerogative of the president and CWC members and no one else has the power to do so.
"What was done yesterday by certain parties created a lot of confusion and I hope our letter today to the RoS will put the matter at rest," he said, referring to Dr Subramaniam's press statement yesterday.
This means the RoS database will list both Palanivel and Dr Subramaniam as presidents, Sothinathan explained, adding that it is now up to the court to decide on the matter.
"This is a general standard operating procedure of any government department, that is to send a letter of notification but that has been manipulated by politicians to hoodwink the public," he said.
Palanivel and Dr Subramaniam are fighting for control of the party after the RoS declared the results of MIC's party election in November 2013 null and void following disputes.
Dr Subramaniam says he is now acting president while Palanivel maintains that he is still the president.
Palanivel filed for legal action against the RoS to challenge its order to hold a re-election, but lost his move for a stay on the directive in court yesterday.
