Hong Leong Bank Bhd did not consult NUBE in relation to the MSS offered to its workers.
The MSS was issued on 20 October 2015 to all employees but NUBE was merely notified via fax at 5.30pm on 19th October 2015 and email on 20 October 2015.
The statement by the CEO of the Hong Leong Bank is misleading the press and the public.
Hong Leong Bank is legally required to consult NUBE and justify the need for the MSS. This act by the Bank is a breach of the current Collective Agreement and the Code of Conduct for Industrial Harmony.
Article 6 of the Collective Agreement imposes a legal duty on the bank to recognise NUBE as the sole negotiator for the worker within its scope whilst the Code of Conduct for Industrial Harmony laid down clear guidelines for employers during economic slowdown.
The purported justification of CIMB Bank for the MSS being a mutual benefit to the banks and the workers is not a valid justification particularly in the present economic climate.
Hong Leong Bank introduced similar forms of retrenchment in the last quarter of 2013.
The unreasonable use of the Separation Scheme was reported to Bank Negara, Ministry of Finance and Ministry of Human Resource but there has been no response from these government organs.
Instead of focusing on preventing abuses of Malaysian workers right to livelihood; it seems the government is making preparation to grant employment for the 1.5 Million Bangladesh workers.
This gives us more the reason to believe the government is unable to control the exploitation of certain banks and is causing unsecured employment.
This is a breach of social obligations by the of the government and Hong Leong Bank.
These unethical and irresponsible conducts must be stopped to preserve peace and harmony in the financial sector.
