Appellate Court refuses bail for lawyer Kamal Hisham



A three-member bench of the Court of Appeal today refused to allow bail to lawyer Kamal Hisham Jaafar who was on the run and is facing several criminal breach of trust charges and also under the Companies Act at the Johor Baru Sessions Court.
Court of Appeal president Justice Md Raus Sharif said they are dismissing the application and agreed with the preliminary objection raised by the prosecution that it is not appealable as this does not constitute a decision pending a trial.
The other judges were Court of Appeal judges Justice Idrus Harun and Zamani A Rahim.
Kamal Hisham was previously linked to the previous Johor sultan, the late Sultan Mahmud Iskandar Ismail, and had claimed that he cannot remain in the country for fear of danger to his life by the present sultan.
He left Malaysia in April 2011 and took up in residence in Dubai. He returned home last year and was arrested.
It was reported that the Johor Baru Sessions Court had granted him bail of RM700,000 with two sureties, that he surrender his passport and that he report to the police station every month.
The Johor Baru High Court had revoked the bail on Sept 21 when it exercised its revisionary powers to call the papers.
