The High Court in Kuala Lumpur today allowed Prime Minister Najib Abdul Razak's application to strike out two paragraphs of Petaling Jaya MP Tony Pua's defence which are related to 1MDB.
Judicial commissioner Roslan Abu Bakar in his decision noted that this was an interlocutory application but said the statements were based on hearsay.
"It did not state where is the source of information and for this reason, it does not fulfil the court rules.
"Hence the court strikes out the two paragraphs from the first defendant's affidavit," he said.
Roslan, however, dismisses Najib's application to strike out three paragraphs of Media Rakyat owner Chan Chee Kong's defence of fair comment, saying it fulfils the court rules.
Lawyer Gobind Singh Deo said he would look at the grounds of the decision and decide whether to file an appeal.
The court has fixed May 30 to hear Pua's application to strike out Najib's suit.
