PKR leader N Surendran has filed an application to strike out a sedition charge against him on the grounds that it is an interference with his duties as a lawyer.
"I'm alleged to have uttered the (seditious) statement when I came out of court after representing (jailed former opposition leader) Anwar Ibrahim at the Federal Court.
"Because it deals with something I allegedly said in my capacity as a lawyer, that is interference of duties of lawyers.
"On those grounds, the (sedition) charge should be set aside or struck out," he told Malaysiakini today.
The application was filed today at the Kuala Lumpur High Court.
Surendran, who is also the Padang Serai MP, said that the sedition charge against him was a breach of the Legal Profession Act 1976 as well as the United Nations Basic Principles on the Role of Lawyers.
He also believed that the charge against him was malicious in intent and also that the criminal proceedings against him a serious abuse of process.
These were his justifications in his affidavit filed for the charge against him to be struck out.
They are now awaiting for the hearing date for his application to be set.
Surendran was first charged under the Sedition Act for his remarks on Anwar's Sodomy II case in Aug 2014.
He had allegedly said that Anwar's Sodomy II charge was a political conspiracy involving Prime Minister Najib Abdul Razak when he was leaving the Federal Court on Aug 8, 2014.- Mkini
