Khir Toyo's property forfeiture application postponed



Former Selangor menteri besar Dr Mohamad Khir Toyo and his wife's application to the Federal Court on the forfeiture of their Balinese-style mansion has been postponed.
The court fixed Feb 27 as the next hearing date, upon a request for the postponement from Khir's lawyer, with no objections from the deputy public prosecutor.
"Last week, on Wednesday, they received the affidavit (from us).
"After they saw our affidavit in reply, there were certain things they wanted to hash out. They need more time to respond to the affidavit," deputy public prosecutor Awang Armadajaya Awang Mahmud told reporters at the Federal Court today.
Awang Armadajaya said Khir's application was to clarify the court order regarding the forfeiture of his Balinese-style mansion, which is held in joint ownership with his first wife, Zaharah Kechik.
Khir was originally sentenced to a one-year jail term for using his position to obtain land and the mansion, and a forfeiture order on the property was also issued.
"Because (the property) is under joint ownership but the wife was not charged, so you can't forfeit her share (of the property)," the prosecutor explained.
As such, they are seeking to clarify how to carry out the court order to forfeit only Khir's share of the property.

"We want an exact formula, to figure out how much is due to the government," Awang Armadajaya said.
He added that he would oppose any attempt to change the forfeiture order.
Khir was granted parole on March 29, 2016 after serving six months in Kajang Prison.
His remaining sentence was served at his family's house in Shah Alam.
Under the parole system, a prisoner serves his remaining sentence outside the prison and lives with his family while under the supervision of a parole officer.- Mkini
