UN Human Rights Office condemns Batumalai brothers' hanging



The United Nations (UN) Human Rights Office for South East Asia has condemned the "secretive" execution of brothers B Rames and Suthar Batumalai early this morning.
It expressed concerns that judicial procedures in the case did not fulfil principles of fair trial and due process, more so when a clemency appeal by the brothers was still being processed by the Pardons Board.
"We are gravely concerned that the executions of Suthar and B. Rames Batumalai went ahead, despite the pending decision by the Pardons Board on their clemency petition and the allegations that their trial did not meet international standards.
"According to international safeguards, capital punishment shall not be carried out pending any appeal or other recourse procedure or other proceeding relating to pardon or commutation of the sentence," said Laurent Meillan, the office's acting regional representative.
The two brothers, who were convicted of murder in 2010, were hanged at dawn today despite the submission of a clemency petition last month containing new evidence in the case. The men were granted a temporary stay of execution from their original Feb 24 execution date, as a result of the petition.

Prison authorities informed the Batumalai family on Monday that the men would be executed on Friday March 17 and advised them to pay them a final visit. However, for unknown reasons, the family was informed yesterday that the executions would be carried out this morning.
“We are particularly disturbed that these executions were both rushed and secretive and that very little notice was given to the family. It is simply cruel and inhumane to not give them or their family adequate notice," said Meillan.
The office also repeated its call for the government to take steps to establish a moratorium on the death penalty as part of a process towards the full abolition of capital punishment.- Mkini
