Rafizi bids to set aside NFC contempt proceedings



PKR vice-president Rafizi Ramli has applied to set aside a contempt proceeding against him initiated by the National Feedlot Corporation Sdn Bhd and its chairperson Mohd Salleh Ismail.
Rafizi's lawyer, Razlan Hadri Zulkifli, said Salleh and NFC had obtained ex parte leave to initiate committal proceedings from the High Court in Kuala Lumpur last May 23.
“However, the papers were served on us late July. We applied to set aside the committal in August,” he said.
The committal proceedings relate to two articles which appeared on Rafizi’s blog and four articles in Keadilandaily.com, which are said to be related to NFC.
Razlan, when met by reporters after he, Salleh, and NFC's senior lawyer Muhammad Shafee Abdullah met Justice Nik Hasmat Nik Mohamed in chambers today, said the judge has fixed a hearing for Feb 23.


NFC and Salleh want the articles in question to be taken down, as the High Court had imposed an injunction on articles related to NFC.
However, Razlan argued that the articles in question are not covered by the injunction.
Rafizi and Malaysiakini were previously sued for defamation over the NFC project, with Justice Azizul Azmi Adnan finding the PKR MP guilty of libel, and ordering him to pay RM150,000 to Salleh and RM50,000 to NFC, along with costs of RM100,000.
Azizul however, did not rule that Malaysiakini had defamed NFC and Salleh, and ordered the two to pay RM50,000 cost to the news portal.
The matter is presently pending appeal from both Rafizi and NFC.
Last September, it was reported a bankruptcy notice was issued to Rafizi for not paying the amount. However, he was later able to come up with the amount.- Mkini
