PORT KLANG – 1Malaysia Development Berhad (1MDB) has laid claim to the superyacht Equanimity.
Lawyers acting on behalf of 1MDB, two of its subsidiaries, and the government said they all claimed ownership of the Equanimity because they believe their money was misappropriated and used to purchase the vessel.
“That claim is based on the allegation that was filed by the (United States) Department of Justice (DOJ) in June last year.
“The DOJ complaint is verified against a penalty of perjury. So it carries a lot of weight,” lawyer Sitpah Selvaratnam told reporters on Tuesday (Aug 8) at the Boustead Cruise Centre, Pulau Indah where the Equanimity was docked.
The lawyers had obtained a warrant of arrest against the ship from the Admiralty court in Kuala Lumpur. Sitpah said that a case would go to trial at some point before this court.
“The rule of law has been totally maintained. The defendants who claim they are the owners have the opportunity to turn up in court to defend the claim and establish their ownership,” said Sitpah.
She added that they had to abide by the procedure of arrest by climbing up the mast as high as possible to attach the arrest warrant.
A sheriff of the Admiralty court served the warrant of arrest on the mast.

The lawyers in their submissions to the court claimed that the money to purchase the superyacht was made in four tranches between Jan 2014 to June 2014.
They say all this money belongs to 1MDB and its two subsidiaries.
Sitpah said there were 17 crew members on board including the captain who is from Norway. None of the crew spoke to the media.
Sitpah said they would go to court some time next week to get directions on how to maintain the vessel and what will happen to the crew.
“It is under the custody of court. It cannot be moved and cannot conduct any activity without their permission,” she said adding that the crew will be allowed to go out for now.
Sitpah also said that ball was in the registered owners hands on their next move. – ANN
Najib denies knowledge of link between Equanimity and 1MDB
KUALA LUMPUR: Former prime minister Datuk Seri Najib Abdul Razak says he has no knowledge on whether the Equanimity super yacht was purchased using funds from 1Malaysia Development Berhad (1MDB).
“We do not know … it’s subject to investigation,” he said when met at the Parliament lobby today.
He also asked for investigations to be conducted to ascertain the yacht’s ownership.
“Of course I have no knowledge of it, I have not been on board. I did not know about it until it came out in the press,” Najib added.
On why the government under him did not pursue the matter, Najib said the government then was more interested in full settlement with the United Arab Emiartes, on the International Petroleum Investment Company (IPIC) issue.
“That is worth much more than this Equanimity. But Equanimity, is being used, again, as a populist move.”
What was important, he said, was the overall settlement of the IPIC issue.
“You’re going to get much more in the settlement with UAE and IPIC as opposed to just making an open bid for the Equanimity,” he said.
Luxury yacht Equanimity, linked to businessman Low Taek Jho, or Jho Low, arrived in Malaysia after making its way from Indonesia. The vessel, which was escorted by Malaysian police, docked in Port Klang at about 12pm today.
It is learnt that several senior officers from the Marine Police were also on the vessel after transferred from the Indonesian authorities in the waters off the Singapore Straits.
The Indonesian government handed over the yacht to the Malaysian authorities following a request by Prime Minister Tun Dr Mahathir Mohamad, during his visit to the republic in June.
“The asset (yacht) will depreciate in value over time. Not many people in the world can buy a yacht like that,” Najib said. – THE SUNDAILY
