MIC urges Home Ministry to revoke citizenship of Malaysian in Germany

 


MIC has urged the Home Ministry to revoke the citizenship of a Malaysian in Germany for issuing inflammatory and racist statements against the royal and government institutions through a video on social media.

Party information officer T Rajagopalu said the 39-year-old individual known as N Ganesparan is a threat to the unity and harmony of the country by arousing religious sensitivities which can result in racial unrest and division.

“MIC strongly condemns the actions of Ganesparan, a Malaysian citizen who is hiding in Germany.

“We urge that immediate action be taken by the government so that elements disloyal to the country like this are stopped from continuing to threaten and contaminate the harmony of the people and our country.

“Ganesparan’s citizenship should be stripped because the individual is no longer loyal to the country through his actions or words, as enshrined in our country’s constitution,” Rajagopalu told Malaysiakini.

Serial offender

Yesterday, Bukit Aman said the police are unable to issue an Interpol Red Notice against Facebook user Ganesparan Nadaraja for inciting racial and religious issues online.

Police criminal investigations chief Mohd Shuhaily Mohd Zain explained that Ganesparan is living abroad and racial and religious issues are not listed under Article 3 of Interpol’s constitution, which forbids the organisation from undertaking any intervention or activities of a political, military, religious, or racial character.

A total of 22 investigation papers have been opened against Ganesparan for talking about 3R (race, religion, royalty) issues in his videos since 2018, he added.

Previously, Bukit Aman Criminal Investigation Department Abdul Jalil Hassan revealed that the investigation against Ganesparan had revealed that the letter uploaded a video titled “Racist in vaccine Malaysia” on his Facebook page.

“In the video, the suspect claimed that low-quality and ineffective vaccines from China, of the Sinovac brand, were given to non-Muslims, while Muslims were given high-quality vaccines from Pfizer,” he said.

The eight-minute-and-54-second video garnered 550 responses, 247 comments, and 395 shares, along with around 10,000 views.

It also went viral on WhatsApp.

“An inspection with the Immigration Department found that the suspect’s last movement was on Nov 2, 2017, through the Kuala Lumpur International Airport and his passport status was also cancelled on Nov 25 last year,” he added.

Ganesparan is being investigated under Section 4(1) of the Sedition Act 1948, Section 505(b) of the Penal Code and Section 233 of the Communications and Multimedia Act 1998, Jalil said.

Section 4(1) of the Sedition Act defines the offender as anyone who carries out any act that has a seditious tendency. On conviction, the first-time offender is liable to a fine not exceeding RM5,000 or imprisonment for up to three years or both. Subsequent offences are punishable with a maximum jail sentence of five years.

Section 505(b) of the Penal Code criminalises the making, publishing or circulating of any statement, rumour, or report with the intention to cause or that is likely to incite fear or alarm in the public. The offender may face imprisonment of up to two years, a fine or both.

Section 233 of the Communications and Multimedia Act stipulates offences of using network facilities to transmit communication deemed to be offensive or could cause annoyance to another person. An offence under the section is punishable with up to one year’s imprisonment, a fine up to RM50,000, or both. - Mkini
