Ex-AG officer’s suit against Sarawak Report editor to begin next year

 

Clare Rewcastle Brown is being sued over a Sarawak Report allegation regarding a post-mortem on Kevin Morais.

KUALA LUMPUR: A RM100 million defamation suit filed by the former special officer to ex-attorney-general Mohamed Apandi Ali against Sarawak Report editor Clare Rewcastle Brown will be heard next year.

Lawyer David Gurupatham, who is appearing for Mabel Sheila Muttiah, said a case management before High Court judge Azimah Omar had been fixed for Jan 5.

“Trial dates will be fixed as most of the documents have been filed,” he told FMT in updating the progress of the case.

David said an application by Mabel to obtain certain documents from Rewcastle Brown was “ongoing”.

Legal firm Suflan T H Liew & Partners are representing Rewcastle Brown.

Mabel said the suit was filed for “a very serious allegation levelled against a member of the administration of justice”.

In her statement of claim filed last year, Mabel is asking for aggravated and exemplary damages, together with an injunction against causing further defamation, as well as a mandatory order for Rewcastle Brown to remove a posting from the website.

The Sarawak Report article titled “How AG’s Office connived to prevent a second post-mortem on Kevin Morais – exclusive expose”, had alleged that Mabel had sent texts to the family members of the late deputy public prosecutor urging them to expedite the cremation of his remains to prevent a second post-mortem.

Morais’ remains were found in a steel drum after he was kidnapped from his car on the way to work in September 2015.

A former army doctor and five others were sentenced to death in July after they were found guilty of the murder. - FMT
