Selangor police have refuted a viral complaint surrounding a recent raid on an individual's home, in response to its owner, activist Jufazli Shi Ahmad, who demanded the raiding team to produce a search warrant and an arrest warrant.
Selangor acting police chief Arjunaidi Mohamed (above) confirmed the raid was conducted to assist investigations under Section 504 of the Penal Code, as well as Section 233 of the Communications and Multimedia Act 1998.
"The action (raid without a warrant) taken by the police in this issue was based on the legal provision as provided for under Section 248 of the Communications and Multimedia Act 1998," Arjunaidi said in a statement issued last night.
"In relation to that, the police would like to advise members of the public not to be influenced and make undue speculations surrounding this case, as this could cause mass confusion," he added.
Arjunaidi was responding to a four-minute-30-second viral video that showed Jufazli in an altercation with the raiding team, demanding that they produce a search warrant and an arrest warrant.
Section 504 of the Penal Code and Section 233 of the CMA are on non-seizable offences and provide for a punishment of less than three years' imprisonment upon conviction.
However, Section 248 of the CMA authorises a police officer not below the rank of Inspector to conduct a raid without a warrant.
This is subjected to a reasonable belief that an ongoing investigation would be adversely affected or evidence of the commission of an offence is likely to be tampered with, removed, damaged or destroyed, in the event of a delay to obtain a warrant. - Mkini
