Tony Pua sues Chegubard for defamation

 


Damansara MP Tony Pua Kiam Wee is suing former PKR member Chegubard for defamation over an allegation linked to the appointment of Sime Darby Property's CEO.

The civil action is over Chegubard’s two postings uploaded to his official Facebook page between Oct 23, 2019, and Sept 19, 2019, during the previous Pakatan Harapan administration.

The DAP lawmaker filed the writ of summons at the Kuala Lumpur High Court on Jan 27 this year, listing Badrul Hisham Shaharin, the real name of Chegubard, as the defendant.

According to cause papers sighted by Malaysiakini, Pua is suing over allegations related to purported efforts to ensure businessperson Voon Tin Yow be appointed as CEO of Sime Darby Property.

The plaintiff was political-secretary to then finance minister Lim Guan Eng, who is also DAP secretary-general.

In 2019, the media reported rumours of Voon being earmarked for the CEO post of Sime Darby Property.

However, then Sime Darby Property group acting CEO Wan Hashimi AlBakri Wan Ahmad Amin Jaffri had dismissed the rumour, labelling it as mere speculation.

Voon was then Eco World Development Group Bhd's director. In April 2020, he left that company to assume the post of CEO of IOI Properties Group.

Through the present legal action, Pua claimed that despite having issued two letters of demand, on Oct 29, 2019 and Nov 15 of 2019, Chegubard still refused to withdraw the purported defamatory postings and publish an apology.

“Accordingly, unless restrained by this honourable court, the defendant will continue to publish, cause, or permit the publication of the First Defamatory Words (in the first posting) and Second Defamatory Words (in the second posting) or words to the like effect of and in relation to the plaintiff,” Pua claimed.

The lawmaker is seeking an injunction to restrain Chegubard from further publishing the allegations.

Pua is also seeking general, exemplary, or aggravated damages, five percent annual interest on any damages awarded calculated from the date of judgment to full payment, costs, and any other relief deemed fit by the court.

When contacted by Malaysiakini today, Pua’s counsel Tan Cheng Leong confirmed that the cause papers have been served on Chegubard last week.

The lawyer added that the matter has been fixed for case management before the Kuala Lumpur High Court Registry on April 9. - Mkini
