Motorist in Seremban, AES 'catches' her in KL



A marketing executive has challenged a summons issued under the Automated Enforcement System (AES), on the basis that neither she nor her car were in Jalan Klang Lama at the time of the alleged incident on Sept 25.

Shoba Karunakaran, 34, claimed trial in the Kuala Lumpur Magistrate’s Court to a charge that she did not stop at a traffic light when the light was red. The alleged incident was caught on a speed-camera.

She told reporters that she was shocked to receive the summons.

“I was on holiday in Seremban that day and was still asleep that morning when I was supposed to have committed the offence. So I am puzzled as to why I’ve been summoned,” she said.

Shoba was among 27 motorists present in court today, although 914 summonses had been issued.

Of those in court, 12 pleaded guilty and were fined RM300, while eight including Shoba have claimed trial.

Seven others pleaded guilty but were let off with a warning by the magistrate because of faulty traffic lights or heavy traffic which resulted in their being caught in the yellow box.

NONEThose who claimed trial are represented by Zul Hazmi Shariff and Ahmad Zamri Asa’ad Khuzaimi(right), under the PAS-led Kempen Anti Saman Ekor which is lobbying against the AES and providing free legal aid to motorists.

Yesterday, 238 cases were registered but only six motorists had shown up in court - two have claimed trial.

Advice for motorists

Zul Hazmi and Ahmad Zamri advised those who have received summonses to attend the court proceedings, saying it is not necessary to pay the fine on receipt of a summons.

“(As seen this morning) some (motorists have been) let off with a warning,” said Zul Hazmi. 

However, those offering grounds for mitigation should be able to substantiate their explanation, he said, so that the magistrate can exercise discretion in making a decision.

NONEZul Hazmi also saidregistration counters have been set up to assist motorists at the PAS headquarters in Jalan Raja Laut and at the  Kampung Baru service centre in Kuala Lumpur, and at the PAS headquarters in Kedah and Perak.
Those who do not settle the summons within 60 days of its issuance can be taken to court. Those who fail to attend court have six months to enter an appearance, after which a warrant of arrest may be issued.
