GE13: Tindak Malaysia founder to be probed under Sosma over randomisation

by Stephanie Sta Maria

PETALING JAYA (April 18): Tindak Malaysia founder, Wong Piang Yow, will be investigated by Bukit Aman tomorrow for urging voters to demand a random ballot paper at polling centres.

PY, as he is better known, will be investigated under Section 124C of the Penal Code which involves attempting to commit activity that is detrimental to parliamentary democracy.

According to human rights lawyer Fadiah Nadwa Fikri, Section 124C falls under Chapter VI (Offences Against the State) of the Penal Code and is a security offence under the 1st Schedule of the Security Offences (Special Measures) Act 2012 (Sosma).

When contacted, PY said that he had received a call from Bukit Aman this morning requesting him to be at the police headquarters at 9am tomorrow.

Tindak Malaysia has been urging voters through its training workshops to ask for a random ballot paper instead of the one handed to them from the ballot booklet by the presiding officer.

"I'm surprised that teaching the election law would offend anyone," PY said. "The issue should be about the right of voters to enjoy the secrecy of their votes."

"But let's see what happens tomorrow. I don't want to say too much about this now."

Tindak Malaysia recently stopped advising voters to demand randomisation of ballot after a number of NGOs voiced concern that it could disrupt the polls.

The Election Commission (EC) has asked voters to follow voting procedure on May 5 to avoid causing "havoc".

Earlier this week, the EC said that secrecy hadn't been an issue since 2004 when the linkage between the electoral roll and ballot paper ceased to exist.

Election watchdog, Bersih 2.0, has taken a similar stand as the EC in discouraging randomisation of ballot.
