Two Pakatan leaders to be charged under PAA

Ipoh Timor MP Thomas Su is expected to be charged next Monday under the Peaceful Assembly Act 2012 (PAA) in regards to a post-electoral rally in Ipoh two weeks ago.
Along with Su, PKR Perak secretary Mohammad Anuar Zakaria has also been summoned by the police to appear on Monday for him to be charged under the same law at the Ipoh Sessions Court on the same day.

NONEWhen contacted by Malaysiakinitoday, Su, the DAP assistant organising secretary, confirmed the matter, stating that the investigating officer of the case requested he present himself at the Ipoh Sessions court on May 27.

Su (left) said he will be charged under Section 9(1) of the PAA for failing to give the police prior 10-day notification before holding a rally on May 9 in Ipoh to protest against electoral fraud.

“It is proven that the transformation to create democracy is a pack of lies,” he said, adding that the PAA has become a draconian law to suppress the opposition.
Anuar in a posting on his Facebook page, said he had just received a summons from the police to appear at the Ipoh Sessions Court on Monday for organising the Ipoh Blackout rally last May 12.

DAP secretary-general Lim Guan Eng and Gelang Patah MP Lim Kit Siang were among the speakers that evening.

It was also reported that Perak police are also investigating another protest rally, organised by Perak PKR on May 12, which was attended by PKR de facto leader Anwar Ibrahim.
Failing to give 10-day notice
PKR's Seri Setia assemblyperson Nik Nazmi Nik Ahmad was also, on May 17, charged under Section 9(1) of the PAA for failing to give police 10-day notice before holding the May 8 Blackout 505 rally in Kelana Jaya.

If convicted, Su, Anuar and Nik Nazmi could be fined up to RM10,000 each and risk being disqualified as elected representatives.

Under Article 48(1)(e) of the federal constitution, an elected representative would be disqualified if sentenced to a minimum one-year jail term or slapped with a fine of not less than RM2,000, and has not received a pardon.
