Mohd Saiful Bukhari Azlan has filed a RM50 million suit with the Kuala Lumpur High Court against his former employer Anwar Ibrahim for sodomising him in 2008 and defaming him after that.
The suit was filed last June and the matter was brought up today for case management.
Saiful's lawyer Zamri Idrus (left) toldMalaysiakini that the opposition leader made an appearance today and the deputy registrar Norfauzani Mohd Nordin of the court ordered Anwar to file his defence by Sept 3. She also ordered the next case management on Oct 8
The Court of Appeal in February found Anwar guilty of sodomising his former aide at a Desa Damansara condominium unit on June 26, 2008, and sentenced him to five years' jail.
This overturned the 2012 decision of the High Court which acquitted Anwar of the charge.
The case is now pending an appeal by Anwar to have the conviction overturned, while the prosecution is appealing for the Federal Court to have his five-year jail term enhanced.
In the statement of claim, Saiful said the KL High Court had affirmed that he was a credible witness and the Court of Appeal in overturning the earlier decision verified the former aide's credibility and that his testimony could be trusted.
He further said in the suit that he had not defamed Anwar but it was the latter who defamed him by alleging that the police report he lodged against the politician was false and it was lodged with ill intent at various ceramah.
Saiful further listed down the press conferences that Anwar held with the local and foreign media in 2008 to prove his point.
He said Anwar had initially filed a suit against him but later withdrew it after many years.
Statements resulted in public scorn
As a result of the statements made by Anwar during the press conferences, Saiful said it led to public scorn against him and tarnished his reputation.
"Anwar's statement had resulted in public scorn in the social media and various websites. I was also ridiculed by Anwar's supporters.
"There is also a Facebook account ‘We hate Saiful Bukhari’ with 134,000 likes and Anwar's party mouthpiece Keadilan daily published various articles in 2011," he said.
Saiful further claimed that Anwar's qazaf application created the public perception that he (Saiful) could not be trusted.
The incident and defamatory statements had resulted in Saiful not being able to acclimatise himself within society and faced difficulty in gaining employment.
As a result of this, Saiful claimed that he faced public pressure.
He further reiterated that the sodomy incident did happen as claimed in his police report, and that he had given evidence under oath to that effect.
"Furthermore, Anwar did not gave his evidence under oath. He had abused his position as an employer to sodomise me," he added.
Saiful is also seeking general, special aggravated and exemplary damages as part of his RM50 million claim.
