The Military Court in Sungai Besi has today rejected a video recording tendered by the prosecution in Air Force Major Zaidi Ahmad’s trial for giving a statement to the media over the indelible ink issue.
The court rejected the evidence tendered from fourth prosecution witness Lieutenant Colonel Mohammad Rosli Yaakob, following an objection by Zaidi’s counsel, Mohd Hanipa Maidin.
Hanipa said the video recording is considered secondary evidence, and it could not be contrasted with the original recording which had been deleted.
“The court decides to accept the objection from the defence counsel and rejects the evidence that has been tendered,” said Colonel Saadon Hasnan, who is leading the court panel hearing the case.
Zaidi, an air force pilot who leads the 12th Squadron, is facing seven charges under Section 51 of the Armed Forces Act for not abiding by his superior’s orders and making a media statement on the indelible ink.
He stands to face a maximum jail sentence of two years or expulsion from the RMAF if convicted.
The prosecution is led by Major Ahmad Sanusi Ali, Major Ahmad Azam Soip, and Captain Ross Anuar Aripin.
Saadon is leading the five-member panel which also consists of Lieutenant Colonel Zainurin Mohd Dom, Major Khuzairi Mohd Arshad, Major Khairul Nizam Taib, Major S Nadzeer Sallehuddin and Major Noor Azman Ahmad.
Besides Hanipa, Zaidi’s other lawyers are Nasar Khan Mirbaz Khan and Aminuddin Zulkipli.
The afternoon proceedings was later postponed to August 26.
The postponement is to allow the prosecution to check on uncertainties in its submissions.
