Lawyer questions validity of Khalid’s sacking

'PKR disciplinary board decided his fate without convening a hearing.'
Edmund_Bon_300PETALING JAYA: Doubts have been cast on the validity of the PKR Disciplinary Board’s procedures in the sacking of Khalid Ibrahim from the party.
In a letter to the board’s chairman and the PKR President, Khalid’s lawyer, Edmund Bon, questioned whether the party’s constitutional rules were correctly followed in Khalid’s expulsion.
The board, chaired by Tan Kee Kwong, had fixed August 9 as the date for hearing Khalid’s case. But in a letter dated August 8, Khalid asked for clarification of the “nature of the charges” against him and requested a postponement of the hearing.
Bon proceeded to send Tan a second letter dated August 9, which was received by Tan at around 11am. In this letter, he said his client was awaiting the board’s reply to his request.
Bon said he did not receive any replies whatsoever.
Bon asserted that the board arrived at its decision without convening a hearing and with his client “in absentia”.
He also noted that Tan, who is himself under inquiry for alleged mismanagement of funds under the Skim Mesra Usia Emas, proceeded to make recommendations to the Central Executive Committee to sack Khalid.
He stressed the importance of recognising that the time taken from the issuance of the show cause letter to the actual sacking of Khalid was fewer than five days, with little chance for him to defend himself.
Bon requested the names of those in attendance at the Central Executive Committee meeting and how they voted as well as information on the composition of the disciplinary board that deliberated on the issue.
