PKR vice-president Tian Chua will be charged tomorrow with allegedly uttering harsh words at several police officers when they seized his handphone in a hotel on April 14.
Tian Chua, who is also Batu MP, will be charged at 9am at the Petaling Jaya Magistrate Court for using a word or gesture intended to insult the modesty of a person.
Police had previously said that the handphone was seized at a hotel in Petaling Jaya on April 14 to assist in police investigation into a case under the Sedition Act, which involved the MP.
Tian Chua had later claimed that the raid, conducted by 10 police officers who were clad in in civilian attire, was done in a harsh manner.
He said the men had not even identified themselves and only showed a warrant for the handphone but had not clarified what was the purpose of the seizure.
The PKR MP also lodged a report over the incident.
He told The Malaysian Insider today that the charge was brought on as the authorities could not find enough evidence to charge him with the previous sedition charge for which they had seized his phone.
"They are not going ahead with the sedition charge. It is hard for them to. So they decide to charge me with this instead," he added.
If convicted, Tian Chua could be sentenced up to five years in prison with a fine or both.
It is stated under the Constitution that an elected representative will be disqualified from office, if fined more than RM2,000 or jailed more than a year and has not received a free pardon.
