Speaker: PAC can’t release 1MDB interim report

Pandikar cites Standing Order 85 and Parliament Act.

PETALING JAYA: Dewan Rakyat Speaker Pandikar Amin Mulia today sought to prevent the Public Accounts Committee (PAC) from publicising an interim report on its investigation into 1MDB, saying in a press statement that it would be against a parliament standing order and the Parliament Act of 1952.
He cited Standing Order 85, which states that “evidence taken before any Select Committee and any documents presented to such committee shall not be published by any member of such committee, or by any other person, before the committee has presented its report” to Parliament.
Yesterday, the PAC had announced that it would release a brief report of the results of its investigations into 1MDB before proceedings are suspended for about three months.
Pandikar said, “The publication of the interim report is also in contradiction with the Houses of Parliament (Privileges and Powers) Act 1952, which prohibits any member or any committee to give evidence outside the Dewan Rakyat without leave from the House.”
Pandikar also repeated a statement he made last Friday that the PAC could not confer until a new chairman had been appointed.
“Although the remaining PAC members fulfil a quorum, the position of Chairman has been vacated and therefore the PAC cannot continue its proceedings until a new chairman is appointed by the House,” he said.
He said the remaining PAC members did not have the power to elect a new chairman from among themselves.
He also said the Deputy Chairman would be contravening Standing Order 82 (2) if he were to conduct PAC proceedings in his capacity as a deputy.
The PAC had to postpone its proceedings last week when its chairman, Nur Jazlan Mohamed, and three other members were appointed to ministerial positions.
