CIMB has taken Prime Minister Najib Abdul Razak’s son Mohd Nazifuddin Mohd Najib to court over a default in payment in which he had acted as the guarantor of a company.
High Court judge Ahmad Zaidi Ibrahim fixed Aug 1 to decide whether Nazifuddin would have to pay the full amount of RM200,000 or otherwise – which was the sum owed by the hirer.
CIMB had demanded that Nazifuddin, who is Najib's son from his first marriage, pay the sum after the hirer defaulted on the payment which was made under a hire purchase agreement.
But Nazifuddin’s lawyers argued that since it was an on-demand guarantee, the demand CIMB had made was not the same with what it had claimed.
As such, they argued that CIMB was not entitled to the full amount of RM200,000.
They also argued that as CIMB in its letter had demanded RM12,000 from Nazifuddin, the bank should not be claiming for the whole amount owed.
They further argued that the guarantee agreement had stated that their client’s liability was only limited to what was demanded.

The case is at its appeal stage as Nazifuddin had applied to strike out the case while CIMB had applied for summary judgment.
The Sessions Court had previously dismissed Nazifuddin’s strike-out appeal while the summary judgment was allowed – thereby entitling CIMB to claim for the whole amount.
