Vell Paari files summons over Samy Vellu's 'diminished mental capacity'



S Vell Paari has confirmed that he had to file an originating summons at the High Court in Kuala Lumpur against his father S Samy Vellu over whether or not the latter is a mentally disordered person and incapable of managing his own affairs.
"We have no other choice. It's a very difficult decision for the family," Vell Paari told Malaysiakini.
He confirmed that he had instructed his solicitors to file the application on Dec 2 so that an inquiry could be held into his father's medical condition.
Vell Paari said the action has been necessitated by two events.

"Essentially, the first is an action filed against my father and myself by one Meeriam Rosaline a/p Edward Paul.
"Secondly, my father had been diagnosed in 2017 as suffering from dementia due to Alzheimer's disease."
He said that his father is no longer able to recognise many long-time friends, and while he is able to make occasional public appearances, he is no longer in the condition to give speeches.
"In so far as my father's condition is concerned, because of his dementia, my father has poor recall and registration of recent events. The definition of 'mental disorder' under the Mental Health Act 2001 covers his condition," he added.
In the application filed on Dec 2, Vell Paari (above) names his 82-year-old father as the sole defendant.
Vell Paari is also seeking for a consultant neuropsychiatrist to be formally accorded medical access to examine his father, and prepare a medical report on his mental capacity.
He added that his mother and sister were aware of the court action and supported it.
"My father and I have had no difficulties or differences in our relationship. In fact, towards early 2017, my father had authorised me to manage his personal and financial affairs for the benefit of himself and our family," said Vell Paari.
It is believed that the suit filed by Meeriam in the High Court in Ipoh is an RM20 million lawsuit.
Samy Vellu served as Sungai Siput MP for eight terms from 1974 to 2008. From 1979 to 2008 he served two terms as works minister, and one as energy, telecommunications and posts minister. - Mkini
