Taxi driver V Balamurugan may proceed with legal action to delist LTTE, says lawyer



Liberation Tigers of Tamil Eelam (LTTE) linked taxi driver V Balamurugan may still proceed with legal action to delist the defunct militant organisation as a terrorist organisation, his lawyer revealed.
Counsel Omar Kutty revealed this to Malaysiakini today, despite Attorney-General Tommy Thomas this afternoon announcing that the Attorney-General’s Chambers (AGC) has discontinued all LTTE-linked terrorism proceedings against Balamurugan (photo) and 11 others with immediate effect.
On Feb 6, it was reported that Balamurugan, through Omar, filed an application for leave from the High Court to commence judicial review to delist LTTE as a terrorist organization.
While welcoming Thomas’ (below) announcement as a positive development, Omar today cautioned that he and his client Balamurugan may still proceed with the legal action.

Omar said that as long as LTTE is listed in the gazette, there may still be somebody in future who may get arrested and charged in relation to the defunct militant organisation.
“We will get further instruction (from Balamurugan in regards to the judicial review leave application), but we may still proceed regardless as LTTE’s name is still listed in the gazette (of terrorist organisations).
“As long as the name is still there, it could be somebody else (that gets detained and charged in relation to LTTE),” Omar said.
He added that the judicial review leave application seeks to ensure no more individuals be unnecessarily be arrested and hauled before courts to answer charges in relation to LTTE.
Omar said with the judicial review leave application coming up for case management before the Kuala Lumpur High Court on Monday (Feb 24), he would use that as an opportunity to get further instructions from Balamurugan on whether to continue with the legal action.
On Jan 29, the Kuala Lumpur High Court dismissed LTTE-linked Gadek assemblyperson G Saminathan’s bail application, on grounds that the militant organisation is still listed in the gazette of terrorist organisation, among others.
Saminathan, 34, and Balamurugan, 37, were among 12 individuals hauled before Sessions Court nationwide from Oct 29 last year, to face terrorism charges over their alleged involvement with LTTE.
The others are Seremban Jaya assemblyperson P Gunasekaran, 60; DAP member V Suresh Kumar, 43; dispatch rider S Teeran, 38; scrap metal dealer A Kalaimughilan, 28; the chief executive of a corporation S Chandru, 38; technician S Arivainthan, 56; storekeeper S Thanagaraj, 26; security guard M Pumugan, 29; restaurant operator B Subramaniam, 57; and secondary school teacher Sundram Renggan @ Rengasamy, 52.
As of today, none of them has been granted bail and still remain under remand.
