Magistrate Maslinda Selamat imposed the sentence after P Mahendran, 31, pleaded guilty to four charges. She also ordered the accused to serve 22 months’ jail term in default of the fine.
All the offences were alleged to have been committed at a shop along Jalan Pandan 2, Telok Mengkuang, between 3.15pm and 3.30pm on April 8, Sinar Harian reported.
On the first charge, Mahendran was accused of committing mischief by damaging crockery, a dining table, and equipment inside the shop with the intention of causing loss and damage to its owner, Tiew Siew Ban.
The charge was framed under Section 426 of the Penal Code, which carries a penalty of up to five years’ imprisonment, or a fine, or both, upon conviction.
On the second charge, Mahendran was accused of using criminal force, under Section 352 of the Penal Code, which provides for imprisonment of up to three months, or a fine of up to RM1,000, or both, upon conviction.
On the third charge, he was accused of committing mischief by scratching a police car using a piece of rattan, causing losses amounting to RM3,700.
The third charge was framed under Section 427 of the Penal Code, which carries a penalty of between one and five years’ imprisonment, or a fine, or both, upon conviction.
On the fourth charge, he was accused of using criminal force against a police officer, Fazlan Azir, with intent to deter or intimidate him from carrying out his duties.
Upon conviction under Section 353 of the Penal Code, he was liable to be punished with imprisonment of up to two years, or a fine, or both.
Deputy public prosecutor Amirul Shafiq Yazid handled the prosecution, while the accused was represented by Muqri Khairi, a lawyer from the National Legal Aid Foundation. - FMT
