PUTRAJAYA: The prosecution is withdrawing an appeal for a higher sentence against activist Fahmi Reza, who was convicted for posting a caricature of former prime minister Najib Razak on Facebook three years ago.
Deputy public prosecutor Zaky Asyraf Zubir informed the Court of Appeal today that the prosecution had filed a notice not to pursue the appeal last month.
A three-member bench chaired by Mohtarudin Baki then struck down the appeal against the decision of the High Court.
On Nov 12 last year, the High Court in Ipoh set aside a one-month jail sentence by the Sessions Court on Fahmi over his clown caricature of Najib, the then prime minister.
Judicial commissioner Mohd Radzi Harun also reduced the RM30,000 fine to RM10,000, in default a month’s jail.
Fahmi has filed an appeal to set aside the conviction but the prosecution wanted a stiffer punishment.
His lawyer Louis Liaw told reporters his client’s appeal against the conviction would be heard on another date.
He was charged under Section 233(1)(a) of the Communications and Multimedia Act.
On Oct 11, the Kuala Lumpur Sessions Court had acquitted Fahmi of another charge for posting a Najib lookalike clown drawing after the prosecutors decided not to proceed with the case any further. - FMT
