Suspect not in lockup attire as IGP’s orders allow this, say cops

KUALA LUMPUR: The boss, alleged to have beaten his two bodyguards for fasting, did not wear lockup attire when he was brought to court because police were adhering to the set procedures.

Citing the Inspector-General of Police’s Standing Orders (Perintah Tetap Ketua Polis Negara A118), Dang Wangi police chief Mohamad Zainal Abdullah said they were merely following set procedures.

Zainal, who denied the suspect was given special treatment when he was brought to the Jalan Duta courts, said the IGP’s orders stipulated that when a suspect is taken to court, he should be in the attire he was wearing during arrest.

Bernama reported him as saying in a statement that the only exception was when the clothes were needed as evidence in court.

As for not being handcuffed, Zainal said the man was earlier charged at the Klang magistrates’ court for several offences, including assaulting and threatening the victims.

After this, he said the man was granted police bail before being handed over to the South Klang police district headquarters for further investigation.

He said the suspect was not under police custody when he was brought to the Jalan Duta courts.

“For these reasons, police cannot arrest the suspect again and handcuff him for a similar offence just for the purpose of bringing him to the Kuala Lumpur courts.

“There is no issue of the suspect receiving special treatment because the law has provided that no one can be arrested for the same offence, as stipulated under Article 7(2) of the Federal Constitution.

“Police urge the public not to manipulate this issue as it can cause misunderstanding, confusion and give an inaccurate impression. This can affect the image and reputation of the police in the eyes of the community.”

Police issued the statement after a photo of the man, who was not handcuffed and in plain clothes while being escorted by police to court, went viral. - FMT
