KOTA BARU: The Perikatan Nasional (PN) is a valid government from a legal point of view and its administration is still running as usual.
Minister in the Prime Minister's Department (Parliament and Law), Datuk Seri Takiyuddin Hassan said the Attorney-General had confirmed this when he gave his view on the matter.
"He (Attorney-General Tan Sri Idrus Harun) gave his remarks recently. He said the Prime Minister (Tan Sri Muhyiddin Yassin) and existing cabinet ministers still hold executive power according to the Constitution.
"To date, the government is running as usual and his (Idrus) remarks clearly explains that members of parliament are the ones who determine a government. So far, none of them have withdrawn their support for the government, based on the related laws," the Kota Baru MP told reporters after presenting food baskets to villagers at Tanjong Chat, here, today.
On Thursday, Idrus said the existing prime minister and cabinet ministers will remain and continue to exercise the executive authority of the federation.
He said the announcement by Umno president Datuk Seri Dr Ahmad Zahid Hamidi on Wednesday night on withdrawing support for Muhyiddin was only a statement by a PN component party instead of the majority of members of parliament from Umno.
"Based on Article 43(2)(a) of the Federal Constitution, to determine whether a person has the confidence of the majority of the Dewan Rakyat members, it must be decided by the members themselves and not through a statement by a political party or leaders," Idrus had said.
"At the moment, the government has no clear facts to point that the prime minister no longer has the confidence of the majority of Dewan Rakyat members," Idrus had said. - NST
