Why the deafening silence over death of Dutch teen model, says lawyer

PETALING JAYA: The lawyer acting for Ivana Smit’s family has questioned the “deafening silence” of the prime minister and law enforcement agencies regarding the investigation into the Dutch teen model’s death five years ago.

SN Nair said he had written to Ismail Sabri Yaakob on June 28 and copied the letter to Attorney-General Idrus Harun and Inspector-General of Police Acryl Sani Abdullah Sani.

A copy was also extended to Dutch ambassador to Malaysia Aart Jacobi.

“Why the pin drop silence and no official acknowledgement to my letter by any of them?” the lawyer asked.

Nair’s letter to the prime minister was sent after Ismail assured his Dutch counterpart Mark Rutte that there would be a fair and transparent probe into her death.

Rutte had phoned Ismail in June to discuss several issues, including Ivana’s case.

In his letter to Ismail, Nair asked for the removal of investigating officer Faizal Abdullah from the task force probing the death. Faizal is also facing a civil suit by the family.

He said Faizal had wrongly concluded that Ivana had died due to natural causes or suicide without a proper probe despite there being evidence to the contrary, made clear in an inquest.

In a revision proceeding before the High Court, judge Collin Lawrence Sequerah ruled on Nov 22, 2019 that Ivana’s death was due to “person or persons unknown”.

Five days later, then CID director Huzir Mohamed announced the setting up of the task force and reclassified the case as murder.

“It has been close to three years and the family is left in the dark and has had no closure,” Nair told FMT.

Ivana, then 18, was found dead on the sixth floor of a condominium block in Kuala Lumpur on Dec 7, 2017, purportedly after falling from a 20th floor unit occupied by an American couple, Alex Johnson and Luna Almazkyzy.
