Court denies police, govt bid to strike out suit over Dutch model's death

 


The police and the government failed in their bid to strike out a lawsuit over the 2017 death of Dutch model Ivana Smit.

Their application to nullify the civil action by the deceased’s family was dismissed by the Kuala Lumpur High Court this morning, with the suit now set to go for a full trial at a later date.

The family’s civil suit is over the authorities’ alleged shoddy and negligent investigation into the 18-year-old’s death. 

The authorities had sought to strike out the lawsuit on grounds it is purportedly frivolous, vexatious, and an abuse of the court process.

On Dec 7, 2017, Smit’s body was discovered on the balcony of a sixth-floor unit of the CapSquare Residence in Kuala Lumpur, 14 floors below the 20th-floor condo unit of couple Alexander William Johnson and Lunara Almazkyzy. The duo left Malaysia in early 2018.
