Court overturns ex-vice chancellor’s acquittal for power abuse

PETALING JAYA: The Ipoh High Court has overturned a sessions court’s decision in 2019 to acquit and discharge a former vice-chancellor of a public varsity of a charge of abuse of power.

Judicial commissioner Su Tiang Joo sentenced former Universiti Pendidikan Sultan Idris (UPSI) vice-chancellor Zakaria Kasa to 18 months’ jail and fined him RM10,000.

According to Utusan Malaysia, Su granted the defence’s application for a stay of sentence pending Zakaria’s appeal to the Court of Appeal.

However, the court did not grant a stay for the fine, or a further six months’ jail in default.

Zakaria, who used to be the chairman of the UPSI executive management, was charged with using his position to include his son for a job interview at the university in 2014.

He was charged with instructing UPSI registrar Faizi Othman to include the name of Fauzi Zakaria for the job interview on Sept 12, 2014.

The offence was allegedly committed at the chancellery building at UPSI in Tanjung Malim, Perak, between June 24 and Sept 12, 2014.

In 2019, the Ipoh sessions court acquitted and discharged Zakaria without calling for his defence after finding that the prosecution had failed to establish a prima facie case.

Deputy public prosecutor Maziyah Mansor prosecuted, while Zakaria was represented by Awang Armadajaya Mahmud, Shahidah Muslimah Roslan and Noor Hidayah Saad. - FMT
