The Kuala Lumpur High Court has dismissed PAS' bid to strike out Amanah vice-president Mujahid Yusof Rawa's defamation suit against the Islamist party.
In making the ruling yesterday, Judge Ahmad Shahrir Mohd Salleh ordered PAS to pay RM3,000 in costs to the former minister.
According to lawyer Noorazmir Zakaria, who represented Mujahid (above), the case will go for a full trial in 2025.
"During the hearing, the defendant argued that the plaintiff was wrong to sue PAS, and it is the author of the said post that should have been subjected to the suit.
"In addition, the party's lawyer also argued that PAS, as a political party, cannot be sued for defamation, but we argued otherwise," Noorazmir told Malaysiakini.
PAS was represented by lawyer Mohd Faizi Che Abu.
LGBT support claims
It is worth noting that the alleged defamatory post appeared on PAS' official Facebook on Oct 16 last year, and remains online to date.
The post implied that Mujahid, as the religious affairs minister under the Pakatan Harapan administration (May 2018 to February 2020), had allowed, supported, and accepted the LGBT community.
In filing the suit last January, Mujahid said that the post had damaged his reputation and credibility, and caused him emotional stress.
The former Parit Buntar MP named PAS secretary-general Takiyuddin Hassan as the defendant.
In April, PAS countered by filing a bid to nullify the civil action without its merits being heard in a full trial. - Mkini
