Not Khalwat ?

Folks, just a follow up on the khalwat issue. I found this. You can read morehere. I have read that this happens to some extent in the Gulf Arab countries.

Nikah Misyar (Arabic: المسيار) or "travelers' marriage" is a Muslim Nikah (marriage) carried out via the normal contractual procedure, with the specificity that the husband and wife give up several rights by their own free will, such as living together, equal division of nights between wives in cases of polygamy, the wife's rights to housing, and maintenance money ("nafaqa"), and the husband's right of homekeeping, and access etc.

Essentially the couple continue to live separately from each other, as before their contract, and see each other to fulfil their needs in a permissible manner when they please.

Sheikh Ahmed al-Kubaissi from the United Arab Emirates thinks there is no formal problem with 'misyar' marriage. It fulfils all the demands of Islamic law.

“.. wealthy Arab men sometimes enter into a Misyar marriage while on vacation, in order to have sexual relations with another woman without committing the sin of zina. They usually divorce the women once their holiday is over. "

The last line is typical : “they usually divorce the women once the holiday is over”. No need to jump off the balcony either. No snoop squads.

Conclusion : Just to avoid any confusion about what I think of all this : I don’t agree with this Mishar or Mutaa at all. It is no different from prostitution. I think the Muslims are just too confused. From chasing khalwat offenders to jump off balconies to “getting married” for the holidays. The non Muslims just laugh and laugh at all these clownish behaviour. Club of Doom.
