HKL report "inaccurate", Saiful's anus "healthy", "plastic" was inserted

In the second day of the high-profile sodomy trial pressed against Opposition Leader Anwar Ibrahim by his arch rival, Prime Minister Najib Razak, doctors dominated the stand, including forensic pathologist Dr David Wells and DNA specialist Dr Brian McDonald from Australia.

Both experts are witnesses for the defense and they have been following the testimony given by the Najib administration, including from the Chemistry Department and the Hospital Kuala Lumpur for the past few months.

Healthy anus

The second defence witness was Dr Mohammad Osman Abdul Hamid, who had been a medical officer in Pusat Rawatan Islam or PUSRAWI on June 28, 2008, when complainant Saiful Bukhari Azlan came to get a check-up.

The first witness was Anwar, who a day ago read a memorable statement from the dock, accusing Najib, wife Rosmah Mansor and former top cops Musa Hassan and Mohd Rodhwan Ismail as being the people who conspired with Saiful to derail his political career.

On Tuesday, Osman told the court that he had examined complainant Saiful Bukhari Azlan and found his anus to be healthy even though Saiful said he had felt pain when passing motion.

Osman said he had carried out an examination on Saiful using a protoscope and found the anus was healthy. It was after the examination that Saiful told him he had been sodomised by a VIP and that plastic had been inserted into his anus, he added.

Prosecution goes after 'plastic'

Osman disagreed with Solicitor-General II Mohd Yusof Zainal Abiden, who was quick to suggest that the information about the plastic was added to the medical report later on.

"I did record this after Saiful told me this after examining him," said Osman. "I checked with a protoscope."

At one point, Yusof bizzarely asked, "Is (insertion of) plastic (object) sodomy?"

To which, Osman repeated that Saiful "told me after the examination that he was sodomised and a plastic was inserted."

The prosecution is keen to discredit the information about the plastic as it infers that Saiful may have sodomised himself by inserting plastic or getting someone to insert plastic into his anus.

Inaccurate HKL report

The third defence witness, Dr David Wells, who is also an associate professor at Monash University, then took the stand.

When asked by defense counsel Sankara Nair about the controversial Hospital Kuala Lumpur report, Wells said it contained no conclusive findings suggestive of penetration to the anus or rectum nor were there any significant defensive wounds on the body of the patient.

He said he found the report "deficient" and "inaccurate". Wells also said that it was not right procedure to state objective findings or presumptions in a medical report. He had been asked by Sankara if the HKL doctors had done their due process and filled in the forms with their findings in an appropriate manner.

"The word 'conclusive' is misleading and ambiguous at best. It does not actually record. It is inaccurate, yes," said Wells.

"I would also not write a report with the presence of Male DNA types B5, B7, B8 and B9. I would not want to record if you want to interpret it. I am a little disappointed on the history recorded. Some portions of the proforma is partially completed. The question should be asked whether there is any resistance (but was not)."
