The defence still has six witnesses to interview including former IGP Musa Hassan (right) and the two former Indonesian maids of condo owner Hasanuddin Abdul Hamid.
Anwar's lawyer Sankara Nair told Malaysiakini that according to investigating officer Supt Jude Blacious Pereira, the maids, Suliati and Fitria Dipan, have returned to Indonesia and police have yet to locate them.
"The prosecution will have to report to court tomorrow on when they can make all the remaining witnesses available to the defence.
"The understanding in court is that until all the witnesses offered to the defence are made available and interviewed, Anwar's defence cannot proceed. Hence the onus is still on the prosecution to produce them," Sankara emphasised.
Protest at Anwar's presence
On Tuesday, the court dismissed the objection made by the prosecution who protested Anwar's presence when Musa and former Malacca police chief Mohd Rodwan Mohd Yusof declined to be interviewed.
So far, the defence has interviewed 19 witnesses including Najib, Rosmah and former Malacca police chief Mohd Rodwan Mohd Yusof, who was Najib's aide-de-camp when he was the deputy prime minister.
However Najib, Rosmah, and Rodwan, when met by the defence on Friday, said they did not want to be Anwar's defence witnesses anddeclined to answer the questions posed.
Anwar has alleged that Najib and Rosmah had conspired to thwart his political ambitions, just as he was running for the Permatang Pauh parliamentary seat, when his wife and PKR president, Dr Wan Azizah Wan Ismail resigned.
This follows the claim that the two had allegedly met complainant Mohd Saiful Bukhari Azlan, two days before the alleged sodomy incident.
The defence had interviewed five witnesses several weeks earlier and they included former national athlete Mumtaz Jaafar (left), said to be a close friend of Rosmah, Khairil Annas Jusoh, the former special officer to Najib when he was the deputy premier, and Pusrawi Hospital's Dr Mohamad Osman Abdul Hamid, who was the first to examine Saiful.
Hospital Kuala Lumpur's Dr Anantha Raj Daniel and Saiful's sister Saidati have also been interviewed.
Besides Musa and the two former maids, the other three whom have yet to be interviewed are Saiful's fomer fiance's mother Sharehah Md Salim, Pusrawi hospital nurse Yazihan Jusoh, and Anwar's bodyguard Mohd Rasid Mohd Rosdi.
