Yen Yen libel suit settled out of court

Application for open apology by advertising agency director to be heard in court.

KUALA LUMPUR: The High Court here today set Sept 15 for Tourism Minister Dr Ng Yen Yen to be in court to hear an application for open apology by a director of an advertising agency, who allegedly defamed her.

Judge VT Singham set the date after Ng’s lawyer, Sunil Abraham, and lawyer TH Liew, who represented the advertising director, Austen Victor Lauw Zecha, agreed to an out-of-court settlement.

Sunil said the out-of-court settlement was based on certain conditions which included that the application for apology be published in the Sin Chew Daily or Nanyang Siang Pau newspaper within 48 hours after it was read in court.

It should also be broadcast by the Business FM89.9 radio channel for a week, he added.

He said damages should also be paid to Ng within a week after the application for open apology was read in court.

In the suit filed on April 14, Ng claimed that Zecha, 71, a director of TBWA-ISC Malaysia Sdn Bhd and Integrated Strategic Communications Sdn Bhd (ISC), during an interview with radio station Business FM89.9 on March 18 this year, had uttered false, unjustified and defamatory words against her.

She said his utterances that ISC had refused renewal of an advertising contract because she, through her agent, had solicited a bribe in respect of it implied that she was dishonest, corrupt and unfit for public office as well as guilty of abusing her power and position as the tourism minister to make a profit for herself.

In her statement of claim, Ng contended that the defendant’s statements at the interview had damaged her reputation as a politician and tourism minister, including in the eyes of clients and companies that had dealings with the ministry.

Ng is seeking general, aggravated and exemplary damages as well as injunctive relief to restrain the defendant, either personally or through his agent/employee, from publishing similar words defamatory to her.
