MAHB slaps hefty fine on KLIA2 contractor for delays


Malaysia Airports Holdings Bhd (MAHB) has imposed a fine of close to RM200,000 a day on the KLIA2 contractor, with effect from June 16, for delays in completing the airport.

MAHB said UEMC-Bina Puri joint venture had failed to complete the main terminal building by June 15. 

“... in accordance with the terms of contract, MAHB has today issued the certificate of non-completion (CNC) to UEMC-Bina Puri JV, the contractor of the main terminal building, for their inability to complete the work by the approved deadline of 15 June 2013,” the company said in a filing with Bursa Malaysia late yesterday.

“The LAD of RM199,445.40 per day is hereby invoked beginning 16 June 2013.”

The LAD - Liquidated and Ascertained Damages - is a fine imposed on a contractor who fails to fulfill a stipulated contractual obligation. 

azlanThe KLIA2 project was to have been officiated on June 28, in conjunction with the 15th anniversary of the KL International Airport. 

No new completion date has been announced for the new low-cost carrier airport, which is now 90 percent complete.

Bernama last week reported that UEMC-Bina Puri JV had asked for an extension up to September or October to complete the additional works, including the runway and control tower which is yet to be completed. 

Since the project was first tendered in 2009, it has been hampered by numerous problems, causing the cost to more than double, from RM1.7 billion to RM4 billion last year. 

Budget carrier AirAsia, which has committed to moving to the KLIA2 from the Low-Cost Carrier Terminal has called for an independent body to probe the lengthy delay.
