The clock is ticking down on inspector-general of police (IGP) Khalid Abu Bakar and the police against taking “a middle path” to resolve an inter-faith custody, following the Ipoh High Court issuing orders on them on June 11 to find and get back six-year-old Prasana Diksa.
The orders were served on the IGP on Wednesday, and today a copy of the committal order, along with a warrant of arrest and recovery order of the child, issued against M Indira Gandhi’s former husband K Pathmanathan @ Muhd Ridhuan Abdullah, were also given to the Ipoh police station.
“Similar orders have been served on the Kota Baru district police station as Pathmanathan is believed to be with Prasana Diksa there,” said lawyer M Kulasegaran, who is representing Indira Gandhi.
“To date we have not received information from the police in locating them and we hope the police will speed up their efforts with their large resources and decades of expertise to locate and arrest Pathmanathan and send him to Tapah prison and deliver Prasana Diksa to her mother,” he said in a statement.
Kulasegaran, who is also Ipoh Barat MP, said her client is not just another name as she is a mother who had her daughter abducted, converted and hidden from her.
This, he added, should never be allowed to happen and she had exhausted every legal avenue to secure her youngest daughter back in her arms after she had been taken in 2009 when she was 11 months old.
Warning of contempt against the police
The recovery order, issued by Ipoh High Court judge Lee Swee Seng, is an order to the police for the recovery of Prasana Diksa, failing which in 30 days, the police are required to come back to court and explain their failure.
The order issued by Justice Lee was made on June 11, leaving the police with about 20 days for them to comply with the order.
Kulasegaran warned further that if the police refuse to act on the court orders, they will make the necessary applications in court to compel obedience.
He said Indira Gandhi is waiting in anticipation for the day that Prasana Diksa returns to her embrace.
“We also welcome any public spirited individual who may have information as to Prasana Diksa’s whereabouts and is willing to assist her and the police in securing her return,” said the lawyer.
Besides Prasana Diksa, Indira Gandhi and Pathmanathan have another daughter and son, who is presently staying with the mother.
It was reported that Justice Lee had found Pathmanathan guilty of contempt for not returning the child and he has declared the unilateral conversion of Prasana Diksa to Islam and bearing the name Ummu Habibah as null and void last year.
In a related development, the lawyer for S Deepa (left), Joanne Leong, said they will first apply for contempt proceeding against Deepa’s former husband N Viran @ Izwan Abdullah rather than initiating contempt proceedings against Khalid for his statement on taking a middle path.
Deepa is involved in another inter-faith custody battle with Viran at the Seremban High Court, where unlike the Indira Gandhi case, the court did not overturn the conversion of their two children, one of whom was taken by Viran earlier this year.
