Kg Chubadak residents lose battle against eviction


Kuala Lumpur City Hall, the mayor and a developer were successful in striking out a suit brought by the residents of Kampung Chubadak Tambahan, Sentul, in the High Court in Kuala Lumpur today.

They consider the residents illegal squatters who must move out, while the residents say they are the first settlers there and have a right to the land.

The decision was made by Justice Nik Hasmat Nik Mohamed who also gave 14 days for a stay of execution to be filed on today's decision at the Court of Appeal.

One of the lawyers representing the 58 kampung residents, Ahmad Zamri Asa'ad Khuzaimi, told Malaysiakini that the lawyers will file the stay on today's decision soon.

This follows the injunction application filed by the residents earlier this month on June 12 which  lasted until June 26.

However it was reportedthat Kuala Lumpur Mayor Ahmad Phesal Talib (left) had said that the houses of the “illegal squatters” at Kampung Chubadak Tambahan, would be demolished despite the injunction, as he claimed they had been there illegally for 20 years.

Phesal said there was a court order for them to move out and said that the residents were being compensated with RM1,000 by the government and RM7,000 by the developer. They are to move to Bukit Jalil.
