Uthaya’s letter only told the truth

Court of Appeal should have scrutinised contents of letter, not just looked at the alleged offending words literally.
uthayakumarGEORGE TOWN: Human Rights Party leader P Uthayakumar did nothing wrong when he wrote a letter to former British Prime Minister Gordon Brown in 2007 stating that the colonial government had abandoned Malaysians of Indian origin, Hindraf chairman P Waythamoorthy said today.
Waythamoorthy said Uthayakumar should have been acquitted by the Court of Appeal yesterday from his sedition conviction.
He said Uthayakumar was of the opinion that the British government was responsible for abandoning Malaysians of Indian origin in then Malaya.
He added that the human rights activist believed that the former colonial government failed to ensure that Hindu temples and land rights of the Hindu community were adequately protected by the Malaysian Constitution.
“The former Hindraf legal adviser wrote the truth that until today, Malaysian Indians were a landless community,” said Waythamoorthy.
He said the letter had raised a legitimate issue on the demolition of Hindu temples.
He added that the Court of Appeal should have scrutinised the letter’s contents, not just looked at the alleged offending words literally while dismissing the sufferings of thousands of Indians who were evicted from the estates.
Waythamoorthy, who is Uthayakumar’s younger brother, said the judges failed to see the fundamental human rights denied to Indians.
Yesterday, Uthayakumar’s appeal for acquittal was dismissed by the Court of Appeal but his sentence was reduced from 30 months to 24 months.
After an automatic one-third remission of the jail term, Uthayakumar is now scheduled to be released from Kajang Prison on Oct 3.
